Can discount vouchers be sold

Question:

I was given a discount voucher free of charge after making a purchase at a certain store. The voucher that I was given was for a wine store allowing me to claim a £75 discount. As I will not be using that voucher, can I sell it on?

The question requires firstly to understand what a voucher is. Based on our understanding, a voucher is a written authorisation of a promise of a discount; or a representation of credit against future purchases.

The voucher in such scenarios is a mere promise of a discount, and, provided that this is clearly written on the voucher, the merchant can revoke this promise at any time. It is evident from this that when the discount voucher is first issued by the merchant, there is no transaction which takes place; it is merely a promise written on a piece of paper or card. This being the case, the voucher cannot be sold on. This is because there is no asset which is being sold; rather, a promise is being sold which does not constitute an asset.[1]

وقال الكاساني (المتوفى سنة 587هـ): ولا ينعقد بيع الدين من غير من عليه الدين؛ لأن الدين إما أن يكون عبارة عن مال حكمي في الذمة، وإما أن يكون عبارة عن فعل تمليك المال وتسليمه، وكل ذلك غير مقدور التسليم في حق البائع، ولو شرط التسليم على المديون لا يصح أيضا؛ لأنه شرط التسليم على غير البائع فيكون شرطا فاسدا فيفسد البيع (بدائع الصنائع: 148/5)
